El sumak kawsay y sus restricciones constitucionales (Tema Central)

Abstract

El sumak kawsay es un principio milenario del mundo andino. Sin embargo de ello, cuando la Asamblea Constituyente introdujo en el tapete de la discusión, aparecieron diferentes reacciones: unos que defienden al sumak kawsay como un modelo de vida, que rige todo un nuevo sistema económico, social y político del país, otros que asimilaron a ciertos derechos sociales, e, inclusive, llegaron a sostener que “es un invento de algún trasnochado”.1 Trataremos de aclarar que el sumak kawsay en la filosofía andina es un sistema de vida, por ello, en primer lugar realizaremos un acercamiento al sumak kawsay desde la filosofía andina, en donde trataremos de desarrollar algunos principios que viabilizan el sumak kawsay, en segundo lugar, realizaremos un análisis muy breve del sumak kawsay recogido en la Constitución de la República y las limitaciones que ésta impone, asimilando por un lado como principio constitucional, luego como derechos del buen vivir y régimen del buen vivir.

Sumak kawsay is a millenary principle of the Andean world. However, since the Constitutional Assembly began the discussion around this principle, different reactions aroused: on one hand, there are people who defend sumak kawsay as way of living that rules over the economic, social and political systems of a country, on the other hand, there are those who have assimilated this principle to certain social rights. Someone even has affirmed that sumak kawsay is a latenight invent. We will start clarifying that in the Andean philosophy, sumak kawsay is a system of life. Then, we will briefly analyze sumak kawsay as it is regulated in the Ecuadorian Constitution, referring to the limitations imposed in this instrument, in which sumak kawsay is first assimilated to a constitutional principle, then, as a right for good living, and finally, as a regime for good living.
