Criterios de interpretación en la nueva Constitución de Bolivia. Voluntad del constituyente vs. jurisprudencia de la Corte Interamericana de Derechos Humanos (Tema Central)

Abstract

En este artículo se analizará la posibilidad del Tribunal Constitucional Plurinacional de aplicar, como criterio de interpretación, la jurisprudencia de la Corte Interamericana de Derechos Humanos, de forma preferente a la voluntad del constituyente boliviano como otro criterio de interpretación dispuesto expresamente, a ese efecto se tendrá en cuenta el rol de la interpretación constitucional y su relación con las normas internacionales de derechos humanos, el análisis de la posición jurídica de la jurisprudencia de la Corte Interamericana de Derechos Humanos en el sistema jurídico boliviano, el efecto de la jurisprudencia de la Corte en la protección de derechos humanos, y el análisis de esta jurisprudencia en relación con la voluntad del constituyente como criterios de interpretación.

This paper will explore the possibility that the bolivian Plurinational Constitutional Court has to apply as a criterion of interpretation the case law of the Inter-american Court of Human Rights, preferentially to the bolivian Constituent’ control as another criterion of interpretation expressly provided. To that effect, the role of constitutional interpretation is taken into account as well as its relationship with international human rights standards, the analysis of the legal position of the case law of the Inter-american Court of Human Rights in the bolivian legal system, the effect of the Court’s case law on the protection of human rights, and the analysis of this case law in relation to the control of the Constituent as criteria for interpretation.
